READ BEFORE PURCHASING OR USING THIS SITE. By accessing blackflag-sec.com or purchasing any product or service from Black Flag Security Group ("BFSG", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use this site or purchase our products.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Client", or "Buyer") and Black Flag Security Group. These Terms govern your use of our website, services, and digital products. We reserve the right to modify these Terms at any time. Continued use of our site or services after modification constitutes acceptance of the updated Terms.
2. Products and Services
BFSG offers professional cybersecurity consulting services and digital information products. All service engagements are governed by a separate Statement of Work (SOW) and/or service agreement executed between BFSG and the Client. These Terms apply to website use and digital product purchases. In the event of a conflict between these Terms and a signed SOW, the SOW governs.
BFSG reserves the right to refuse service to any individual or organization at our sole discretion, including but not limited to cases where we have reason to believe the requested services would be used unlawfully.
3. Digital Products Policy
ALL DIGITAL SALES ARE FINAL. NO REFUNDS.
Due to the nature of digital products, all sales are final and non-refundable once a download link has been issued or access has been granted. By completing a purchase, you acknowledge and accept this policy without exception.
The following additional terms apply to all digital products sold by BFSG:
- ▸Digital products are licensed for personal or authorized professional use only. Each purchase grants a single-user, non-transferable license.
- ▸Unauthorized redistribution, resale, sharing, or publishing of any BFSG digital product — in whole or in part — is strictly prohibited and will be pursued to the fullest extent of applicable law.
- ▸Products are provided "as-is" for informational and professional security research purposes. BFSG makes no warranty that any technique, tool, or methodology described will produce specific results in your environment.
- ▸Product pricing and availability are subject to change without notice.
4. Authorized Use Only
All BFSG products, services, tools, and educational materials are intended exclusively for authorized security testing, professional research, and lawful educational purposes. By purchasing or using any BFSG product or service, you represent and warrant that:
- ▸You have obtained all necessary written authorization before conducting any security testing on systems, networks, or physical facilities you do not own.
- ▸You will comply with all applicable local, state, federal, and international laws, including but not limited to the Computer Fraud and Abuse Act (CFAA), Electronic Communications Privacy Act (ECPA), and applicable state statutes.
- ▸You are solely responsible for ensuring your use of BFSG products and information is lawful in your jurisdiction.
5. Prohibited Use
You may not use this site or any BFSG product or service to:
- ▸Access, test, or attack systems, networks, or facilities without explicit written authorization from the system owner
- ▸Conduct any activity that violates applicable law or regulation
- ▸Redistribute, resell, or publish BFSG digital products without written permission
- ▸Impersonate BFSG or claim affiliation with BFSG for unauthorized purposes
- ▸Engage in harassment, threats, or abusive conduct directed at BFSG personnel
- ▸Attempt to reverse-engineer, scrape, or extract data from this website in an automated or unauthorized manner
6. Intellectual Property
All content on blackflag-sec.com — including but not limited to text, graphics, logos, digital product content, tools, and methodology documentation — is the exclusive property of Black Flag Security Group and is protected by applicable copyright, trademark, and intellectual property law. No content may be copied, reproduced, distributed, or used commercially without prior written consent from BFSG. Unauthorized use will be aggressively pursued.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BFSG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE, OUR SERVICES, OR OUR DIGITAL PRODUCTS.
BFSG's total liability to you for any claim arising from use of this site or purchase of a digital product shall not exceed the amount you paid for the applicable product. For free resources and general site use, our liability is zero.
You assume all risk associated with the use of security testing information, tools, and methodologies. BFSG is not responsible for any legal consequences, system damage, data loss, or other harm resulting from actions you take based on our products or services.
8. Disclaimer of Warranties
THIS SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BFSG DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF MALICIOUS COMPONENTS.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or your use of BFSG services shall be subject to the exclusive jurisdiction of the state and federal courts located in Troup County, Georgia.
You agree to waive any right to a jury trial and to resolve disputes through binding arbitration before a single arbitrator in LaGrange, Georgia, except where prohibited by law. The prevailing party in any dispute shall be entitled to recover reasonable attorney's fees.
10. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
